This right has been mentioned in the Covenant on Civil and Political Rights and the Covenant on Economic, Social and Cultural Rights, which is indicative of the indivisibility and inseparability of all human rights. One of the most important subjects in the formation of a marriage is that of marital age and conesnt to marriage, which is an international concern and international human rights law has addressed it. Early marriage and any marriage performed without valid consent, have a negative impact on the individual, the family, and society. These pose an especially serious threat to the physical and psychological health of girls who are not physically mature enough as it "increases the risk of unintended pregnancy, maternal and newborn mortality and sexually transmitted infections. "This paper analyses the human rights dimensions of child marriage in detail with a look at the Iranian legal system’s approach to the issue. ازدواج در اغلب جوامع امروزی، و به­ویژه در جوامع سنتی، نقطه آغاز زوجیت و خانواده است که با تولد فرزند کامل می­شود. این حق هم در میثاق حقوق مدنی و سیاسی و میثاق حقوق اقتصادی، اجتماعی و فرهنگی مورد اشاره قرار گرفته که این خود حاکی از انفکاک ناپذیری حقوق بشر است. ازدواج کودکان به دلیل شیوع و آثار غیرقابل جبرانی که بر وضعیت آنان و به­ویژه کودکان دختر دارد یکی از دغدغه­های جامعه بین­المللی است که در اسناد بین­المللی حقوق بشر با تأکید بر اهمیت تعیین حداقل سن ازدواج و ارتباط آن با رضایت به ازدواج به آن پرداخته شده است. به­موجب این اسناد کشورهای عضو ملزم به تعیین حداقل سن برای ازدواج هستند که این سن باید به­گونه­ای تعیین گردد که رضایت شخص به ­ازدواج بتواند معتبر تلقی شود. البته صرف تعیین این سن و جرم­انگاری ازدواج زودهنگام و اجباری بدون پرداختن به ریشه­های آن نه تنها این معضل را حل نمی­کند بلکه می­تواند سایر حقوق فرد را تحت­الشعاع قرار دهد. در این مقاله با مروری بر این اسناد و نظریات تفسیری علاوه بر مشخص نمودن جزییات آن‌ها به وضعیت نظام حقوقی ایران در این خصوص اشاره و پیشنهاداتی ارائه خواهد شد. https://jfr.sbu.ac.ir/article_97217_a009159372c66a3c5756b06e0d2237ab.pdf
