Imposing such standards regardless of their consequences may result in anxiety in the family institution and subsequently in the society itself and may raise the motivation of defensive behaviors among people and as a result will increase the cost of legislative and judicial system. Economic approach to the marriage law with analyzing aftermath of laws on couple's behavior is looking for minimizing marriage costs including couple, society and judiciary system costs, and maximizing the cost of its inefficient breach. Incentive role of family law and its supplements, such as labor laws, tax and employment affairs etc., on the rate of marriage and divorce, the amount of dowry and other couple's decisions is a topic that economics of family law is recently very focused on. This article, in the form of “contract” and “market” and by using of concepts including costs, benefits, efficiency, competition and monopolywill present the economic analysis of marriage and other related legal concepts and is to introduce a new approach to Iranian family legislators and judges. حقوق ازدواج به عنوان بخش جدایی­ناپذیر نهاد مقدس خانواده، ابزار سیاستی است که با وضع ضمانت‌های اجرایی خاص خود، سعی می­کند استانداردهای مطلوب رفتاری زوجین فعلی و آتی را مشخص نماید. به عبارت دیگر سعی دارد وضعیت نهاد خانواده و بازیگران آن را به سمتی سوق دهد که حتی­الامکان منطبق بر الگوی مورد قبول عقل جمعی و شرع حاکم بر آن جامعه باشد. وضع این استانداردها، بدون توجه به پیامدهای آن، نهاد خانواده و متعاقب آن جامعه را با تشویش مواجه ساخته و انگیزه­های رفتاری تدافعی را در افراد تقویت می­نماید و در هر صورت هزینه­های نظام قانونگذاری و قضایی را افزایش می­دهد.رویکرد اقتصادی به حقوق ازدواج، با مطالعه پیامدها و نتایج قوانین بر رفتار زوجین، به دنبال حداقل­سازی هزینه­های ازدواج ـ شامل هزینه­های زوجین، جامعه و نظام قانونگذاری و قضایی ـ و افزایش هزینه‌های نقض ناکارآمد آن است. نقش انگیزشی قوانین خانواده و قوانین مکمل آن ـ قوانین کار، امور استخدامی، مالیاتی و غیره ـ در نرخ ازدواج و طلاق، میزان مهریه و سایر تصمیمات زوجین، موضوعی است که در اقتصاد حقوق خانواده مورد توجه جدی قرار دارد. نوشتار حاضر، در قالب دو عنصر «عقد» و «بازار» و با استفاده از مفاهیم هزینه، منفعت، کارآمدی، رقابت و همکاری، اطلاعات نامتقارن و غیره، به بررسی اقتصادی ازدواج و مفاهیم حقوقی وابسته به آن می‌پردازد و بدین­گونه رویکردی نوین را به قانونگذاران و قضات امور خانواده ایران معرفی می‌نماید. https://jfr.sbu.ac.ir/article_96683_c25372bd6584a7ac9717d84eb0ddacff.pdf
