According to the rule, the mutual legal relationship between wife and husband must be based on the current rational custom of Islamic society. In other words, in addition to what holy Qur’an says, the manner of the Prophet Mohammad, and infallible Imams, new rational customs can and must play decisive role in determining the frame-work of Islamic family law, as  far as they have not been rejected explicitly or implicitly in Islamic teachings.  In this way the examples of customary and reasonable behavior may vary from time to time, place to place and from one culture and civilization to another. Due to the generality of the evidence supporting the rule from the Holy Qur’an, narrations (ahadith) and jurists’ reliance upon the ruling in different cases, the article tries to strengthen and develop the rule and shed light on its implementation in areas like management of the family, sexual relationship, financial issues, residency and decision about reproduction. این مقاله به واکاوی قاعده کمتر شناخته­ شده «لزوم معاشرت به معروف در روابط زن و شوهر» می‌پردازد. به موجب این قاعده، رفتار متقابل زن و شوهر باید هماهنگ با عرف روزآمد جامعه مسلمانان باشد. این به معنای آن است که افزون بر آموزه­های دینی مستفاد از کتاب و سنت، آن دسته از عرف­های عقلانی که در متون دینی صریحاً یا ضمناً از آن­ها نهی نشده باشد، می­تواند و باید هماهنگ با آموزه‌های دینی نقش تعیین­کننده­ای در ترسیم نظام حقوق خانواده ایفا نماید؛ حتی اگر این عرف­ها نوپیدا باشند. بدین­سان «معروف» مفهومی عرفی است که مصادیق آن بر حسب زمان و مکان و نیز درجه تمدن و فرهنگ جامعه اسلامی که زوجین در آن زندگی میکنند، می­تواند متفاوت باشد.مقاله به روش تحلیلی و با استناد به قرآن مجید، سنت پیامبر (ص) و امامان معصوم (ع) و موارد استناد فقیهان به لزوم معاشرت به معروف، برای توسعه آن به یک قاعده فقهی الزامی استدلال نموده و با توجه به عموم ادله نشان داده است که قاعده می­تواند در همه قلمروهای روابط خانوادگی از جمله: مدیریت خانواده، روابط زناشویی زوجین، چند و چون نفقه، سکنای زوجین و تصمیم درباره کم و کیف فرزندآوری مورد توجه قرار گیرد. https://jfr.sbu.ac.ir/article_96426_7bc2310c22f30213957c629c7aea8efc.pdf
