Journal Article 2025 04 11 The right to family is considered a fundamental right for children, but orphaned and children without effective guardians are deprived of this right, and the state must seek to ensure this right for these children through alternative means. A descriptive and analytical review of the regulations in this area, along with a bibliographic study of the research conducted, has revealed that the Iranian legal system provides two solutions for this purpose: "reunification" and "adoption." However, there are several legal and procedural challenges that hinder the provision of this right to such children, including the requirement that at least two years must pass from the acceptance of a child without effective guardianship in welfare centers, the prolonged adoption process, and the stringent and extra-legal regulations of the welfare organization.<br /><br />The protocol for foster care for orphaned and children without effective guardianship was approved in 2023 to establish the foster care institution, reducing the period a child spends outside the family environment, such as in welfare centers, to the minimum possible. According to this protocol, children without effective guardianship can enter the family environment from the beginning of the two-year period until reunification or adoption. «برخورداری از خانواده» به عنوان یک «حق» برای کودک به شمار می رود ولی کودکان بی سرپرست و بدسرپرست از آن محروم هستند و دولت می بایست با توسل به طرق جایگزین به دنبال تامین این حق برای این دسته از کودکان باشد. با بررسی توصیفی تحلیلی مقررات این حوزه و مطالعه کتابخانه ای پژوهش های صورت گرفته مشخص گردید در نظام حقوقی ایران دو راهکار «بازپیوند» و «فرزندخواندگی» بدین منظور وجود دارد ولی برخی چالش های قانونی و اجرایی مانع تامین این حق برای این قبیل کودکان می شود که عبارتند از لزوم انقضای حداقل دو سال از پذیرش کودک بدسرپرست در مراکز بهزیستی، اطاله فرآیند فرزندخواندگی و ضوابط سخت‌گیرانه و فراقانونی سازمان بهزیستی.<br /><br />شیوه‌نامه «مراقبت موقت از کودکان و نوجوانان بی‌سرپرست و بدسرپرست» در سال 1402 به تصویب رسید تا با تأسیس نهاد «مراقبت موقت» مدت نگهداری کودک در خارج از محیط خانواده نظیر مراکز بهزیستی به کمترین زمان ممکن برسد که طبق آن کودکان بدسرپست از همان ابتدای انقضای مدت 2 ساله تا زمان بازپیوند یا فرزندخواندگی می‌توانند وارد محیط خانواده میزبان شوند. کودکان بی سرپرست نیز می‌توانند تا زمان صدور حکم سرپرستی و اعطای فرزندخواندگی در قالب مراقبت موقت وارد محیط خانواده ‌شوند.
